Department of Education of Puerto Rico opens Office of Appeals

 San Juan, .- The Acting Secretary of the Department of Education of Puerto Rico, Eligio Hernandez, announced this Sunday in a statement the opening of the Office of Appeals of the Education System (OASE).

The Law of Educational Reform (Law 85 of March 29, 2018) establishes the creation of the Office of Appeals of the Education System to be integrated as a mechanism to facilitate administrative appeals procedures with the purpose of expediting the adjudication procedures in the appeal. .

“It is our greatest interest to make available to our Department employees mechanisms that expedite the appeals process within the agency.” The newly inaugurated appeals office not only complies with Law 85, but will also serve to seek fair, quick and effective solutions. We have highlighted high-level professionals there to ensure efficient work and to comply with the public policy established in the law, “said Hernández.

Also, the head of Education informed that the OASE will have a director, three administrative judges and support staff.

Complaints or appeals filed by those non-union employees of the Department will be heard in the office.
The judges will attend the appeals of personnel matters in accordance with the procedures and terms as provided in the regulations.

What the regulation establishes must be interpreted in such a way that it fosters a quick and efficient solution in the cases according to the policy established in Law 85.

Exceptions to the transition are those cases that are before the Public Service Appeals Commission with observations of its fund or those in which it was held in its merits and a final termination has not been issued. (EFEUSA)
