The justice denied on Thursday a request to return to Mexico presented by the defense of Mexican actor Pablo Lyle, who is accused of involuntary manslaughter for the death of a man he hit during a traffic dispute in Miami.
Judge Alan Fine did not agree to suspend the house arrest of Lyle, who, according to his lawyers, wanted to return to Mexico before the hearing scheduled for July 11 to be able to work and support his family financially.
The Office of the Prosecutor opposed the defense’s request, considering that there is a risk of flight.
The defense argued in its petition that Lyle, 32, has not broken the rules of his arrest – “has not seen the sun,” said one of the lawyers, “has not missed any of the appointments with the justice and he needs to stay active to earn his living.
At the beginning of this process, when the man he hit, a 63-year-old Cuban named Juan Ricardo Hernández, was still alive in a hospital and Lyle was only charged with assault, was authorized to travel to Mexico for work and returned for a judicial hearing.
Things changed after Hernandez’s death, which Lyle hit and knocked unconscious on a Miami street on March 31, according to a video from security cameras.
The sexagenarian died on April 4 in the hospital to which he was taken after the altercation.
Lyle, who had been arrested shortly after the events and was initially released on bail with $ 5,000 bail, was charged with involuntary manslaughter, a charge he pleaded not guilty on May 1.
Since April 9, he is under arrest at a relative’s house with an electronic shackle and $ 50,000 bail. Judge Fine withdrew his passport.
The beginning of the trial is scheduled for July 22 for the charge of involuntary manslaughter, as well as the aggression, which he already had, according to the judicial record of his case.
Before that, he will have to appear before Judge Alan Fine, of the eleventh judicial circuit of Miami-Dade, on July 11.
A forensic report from Miami-Dade County released on April 10 revealed that Hernandez died of “complications from blunt trauma to the head.”
The forensic doctor’s letter indicated “homicide” as probable cause of death of the 63-year-old man.
Lyle’s defense alleges that the actor “had no intention of killing anyone.”
Lyle was on his way to the Miami airport in a vehicle driven by his brother-in-law, Lucas Delfino, when they came across the car driven by Hernandez, who at a traffic light got out of his car to recriminate Delfino for a maneuver at the wheel.
In the middle of that discussion, Lyle got out of the car and hit Hernandez, who, according to the images collected by the security cameras of a nearby gas station, collapsed instantly.
